Prices Availability Acceptance Delivery Cancellation Returns Payment General Customer services Product Terms Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco.com makes the products available to you ("Product Terms"). 1. Prices The prices payable for the items that you order are clearly set out in the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed in the 'Help' section of the web site. Where items are ordered pre-release, an estimated retail price will be given, in which case the price charged may be different, as the order may have been placed as much as three months prior to release. Back to top 2. Availability If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. Back to top 3. Acceptance There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods. Order status may be checked daily on the Tesco.com website. For pre-release orders, please check nearer the expected release date in case it has changed, especially if required as a gift. Back to top 4. Delivery Delivery will be made to the address specified by you on the completed order form. Please note that we can only deliver products within England, Scotland and Wales. All deliveries are by Royal Mail. We do our best to secure delivery within 30 days of the date of your order (with the exception of items that have not been released yet) but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control. Each item that you order will have an "availability date". This will be one of the following: Available immediately - dispatched within 24 hours of the order being received Temporarily out of stock - normally dispatched within 7 days of the order being received Special order - normally dispatched within 7-14 days of the order being received Not yet released - item will be dispatched as soon as possible after release. If you order items with different availability dates, you can choose to have all the items held until the last item is delivered. If you do not choose this option, each item will be delivered separately, and you will be charged a delivery charge each time. Back to top 5. Cancellation Provided that the goods are sealed, you have the right to cancel your order up to 14 working days after the day following the delivery by calling our Customer Services department on 0870 607 6060. Alternatively, you can cancel your order by post, by fax or e-mail. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods to us and we will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given. If you do not return the goods within 21 days of your cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the web site. This does not affect your statutory rights. Back to top 6. Returns We believe you'll be delighted with your purchase but for any reason you'd like to return an item within 7 working days of receiving the delivery, just follow this simple process. Choose your returns reason from the back of the despatch note and tick the box. Use the peel off label from the despatch note and attach it to the front of the original packaging. Don't forget to include the despatch note. Please use the Royal Mail when returning the package. The Small Print The product must be returned with the original packaging intact. We regret that Tesco cannot be held responsible for non-delivery of returned goods so we recommend you get a certificate of posting from the Post Office. If an item has been returned for any reason other than a product fault or a mistake we’ve made, you will be refunded the cost of the goods and the post and packaging charges but not the return postal charges. Your statutory rights are not affected. Items bought at the tesco.com entertainment warehouses cannot be returned to a Tesco store. Clubcard points will be removed from your account at the rate of one point per pound refunded. Back to top 7. Payment You can pay by any American Express, Mastercard or Visa credit card, Switch or Delta debit card. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will not be charged for items until they are dispatched. The cost of your goods includes a 2.5% transaction fee that is payable to Tesco Card Services Limited. Our liability to you in connection with any order will not exceed the total price charged for the relevant items. We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection. Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order. Back to top 8. General These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
